New regulation on the sale of used cars

The regulation made by the Ministry of Commerce entered into force on 16 August 2022.
Accordingly, the marketing or sale of automobiles and off-road vehicles can only be carried out on the condition that 6 months and 6 thousand kilometers have passed from the first registration date. Unless this condition is met, marketing and sales cannot be made directly or indirectly until July 1, 2023.

The only exception to this rule is the marketing and one-time sale of automobiles and land vehicles registered before 16 August 2022 by those engaged in the trade of second-hand motor vehicles until 15 September 2022.

As of September 15, 2022, the Ministry of Commerce will focus on inspections in order to ensure the implementation of the regulation covering all real and legal persons selling automobiles and land vehicles within the scope of commercial activities. Administrative fines will be applied to detected violations.


Expertise requirement for second-hand traders

According to the regulation, everyone who sells automobiles and land vehicles within the scope of commercial activity, whether or not they have a certificate of authorization, is obliged to obtain an expertise report at most 3 days before each sale and submit this report to the notary public during the sale. Those who do not fulfill this obligation will be subject to an administrative fine by the Ministry of Commerce.


Mileage information requirement

Notaries will be obliged to include the mileage information in the appraisal report during the sale in the sales contract, and to include the buyer and seller’s statement regarding the mileage information of the vehicle in case the appraisal report is not submitted to the notary public during the sale.


Vehicle sales data is recorded

Within the scope of the protocol signed between the Ministry of Commerce and the Notaries Union of Turkey, all second-hand motor land sales data throughout the country are transferred to the Ministry on a daily basis. In this context, vehicle sales data can be monitored and controlled by the Ministry, and it will be possible to detect practices that violate regulations.
As of September 15, 2022, the first registration dates of all vehicles sold at notary publics will be shared with the Ministry, and it will be possible to identify the vehicles sold before 6 months from the first registration date.

Auditing ad sites

As of September 15, 2022, automobile and off-road vehicle advertisements on advertisement sites will also be followed and any violations detected will be penalized.

After the same date, workplace inspections will be carried out in 81 provinces through the Provincial Directorates of Commerce. Cars and land vehicles that are marketed (offered for sale in workplaces) within 6 months and 6 thousand kilometers from the first registration date will be penalized if they are detected.
