According to the regulation made on 16 August 2022 in the Regulation on the Trade of Second-Hand Motor Vehicles, the marketing or sale of automobiles and off-road vehicles within the scope of commercial activity can only be carried out on the condition that 6 months and 6 thousand kilometers have passed from the first registration date of these vehicles. Unless these conditions are met, the marketing or sale of automobiles and land vehicles, directly or indirectly, within the scope of commercial activity will not be possible until 1 July 2023.

The transition period is coming to an end.

The period for marketing or sale of automobiles and off-road vehicles registered in the name of those engaged in the trade of second-hand motor vehicles before 16 August 2022 will expire on 15 September 2022. After 6 months and 6 thousand kilometers after this date, the marketing and sales of these vehicles will not be possible until 1 July 2023.

As of September 15, 2022, inspections will begin.

Marketing and sales restriction inspections for those engaged in the trade of second-hand motor vehicles will begin as of September 15, 2022.

Audits will be made through three different channels.

Inspections regarding the regulation, known as 6 months and 6 thousand kilometers marketing and sales restriction in the public, will be carried out by the Ministry of Commerce through three different channels.

1- Sales records will be followed on a daily basis.

The sales records of second-hand motor vehicles submitted to the Ministry of Commerce with all their details by the Notaries Union of Turkey will be followed up daily.

As of September 15, 2022, sales made daily for 6 months and under 6 thousand kilometers will be monitored and controlled via the relevant information system via inquiry screens. In this context,

Administrative fines will be applied directly to each sale within the marketing and sales restrictions of those engaged in the trade of second-hand motor vehicles with a certificate of authorization.

Within the scope of commercial activity (more than 3 sales in a calendar year), sales of real or legal persons who sell automobiles and land vehicles directly or by proxy without authorization certificate for 6 months and less than 6 thousand kilometers will be determined and an explanation will be requested regarding the said sales. Administrative fines will be imposed on real or legal persons making sales for each of these sales, which are determined to be made within the scope of commercial activity as a result of the examination. Administrative fines will also be imposed on these persons for engaging in second-hand motor land vehicle trade without a license.

Obligation to obtain an appraisal report and submit this report to the notary will also be checked during the audits made on sales records.

Anyone who sells automobiles and off-road vehicles within the scope of commercial activity, with or without a certificate of authorization, is obliged to obtain an appraisal report at most 3 days before each sale and submit this report to the notary public during the sale.

An administrative fine will also be imposed on those who do not fulfill this obligation within the scope of the inspections to be carried out by the Ministry of Commerce over sales records.

2- Workplaces will be inspected.

After September 15, 2022, through the Provincial Directorates of Commerce, workplace inspections will be carried out at auto dealers, car rental companies and authorized dealers in 81 provinces, and marketing and sales activities for vehicles under 6 months and 6 thousand kilometers will be examined.

Workplace inspections to be carried out by the Provincial Directorates of Commerce will continue at regular intervals with all businesses operating in this field.

In addition, direct workplace inspections will be carried out by the Provincial Directorates of Commerce within the scope of complaints regarding the sale or marketing of vehicles under the 6-month and 6 thousand kilometer restriction.

In the event that the activities regarding the marketing of the vehicles within the scope of 6 months and 6 thousand kilometers marketing and sales restrictions are detected in these enterprises, the situation will be recorded and the matter that constitutes a violation of the regulation will be conveyed to the Ministry of Commerce along with the supporting information and documents.

As a result of the examination to be made on the minutes and other information and documents submitted by the Provincial Directorates of Commerce to the Ministry of Commerce, an administrative fine will be applied separately for each sale, for those who violate the legislation.

3- Vehicle advertisements will be inspected.

Advertisement information on vehicles marketed on advertisement sites will be regularly obtained from these sites, and the said marketing and sales activities will be followed.

As a result of the follow-up, control and inspections, auto dealers, car rental companies, authorized dealers and all real or legal persons who make sales within the scope of commercial activity, separately for each sale, administrative money for 6 months and 6 thousand kilometers. penalty will apply.
