The government took action after the Constitutional Court’s annulment decision on the ‘vehicle purchase’

The government took action immediately after the Constitutional Court (AYM) annulled the provision of the law that allows the type and price of vehicles to be acquired by the Presidency and the Grand National Assembly of Turkey to be determined by the top managers of these institutions.

In its decision published in the Official Gazette on 8 August, the Constitutional Court annulled the provisions in the Budget Law that allowed the type and price of vehicles to be acquired by the Presidency and the Grand National Assembly of Turkey to be determined by the top managers of these institutions. In the decision, it was emphasized that the type of vehicles that can be acquired by public administrations within the scope of the general budget and the maximum purchase price should be indicated in the Budget Law. It was stated that the authority given to the Parliament and the Presidency made the Vehicle Law inapplicable. For these reasons, the Constitutional Court declared that the provisions of the law were unconstitutional and decided to annul it.

JUST DECISION

The government, on the other hand, put an article for this in the first “bag proposal” presented as soon as the Assembly was opened. With this article, amendments are made to the Vehicle Law. In the current Vehicle Law, there is a provision that the maximum purchase price of the vehicles to be purchased by the institutions will be shown in the charts attached to the budget laws every year. This provision is changed with the bag offer. It is possible to determine the type and purchase price of some vehicles “within the year”. After this change, the government will add a provision to the Budget Law, allowing the type and maximum purchase price of some vehicles to be determined during the year. Based on this provision, vehicles can be purchased within the year regardless of the “type and price limit” in the Budget Law. In the justification of the article in the bag proposal, it was argued that passenger and service vehicles with security measures are generally purchased for foreign representations and the prices of the vehicles differ according to the countries. For this reason, it was stated in the justification that an average maximum purchase price could not be determined, and it was stated that it was aimed to enable the prices of passenger and service vehicles with security measures to be determined “within the year” according to the principles determined in the budget laws.

With the regulation to be made by the government with a “bag proposal”, the vehicles in this scope, which can be purchased until the end of this year, will again be legally guaranteed.
